Let the battle continue. Some of the cards created by Upper Deck in 2009 are at the center of a controversy, and now a lawsuit, between the big two card manufacturers. Topps is claiming that Upper Deck pilfered Topps’ 1975 set design. If you take a look at the similarities, you’ll see that Topps is probably right that Upper Deck is using their 1975 design this year. The question we have to ask here though is: so what? So what if Upper Deck is using a design extremely similar to one that Topps used over 30 years ago? Unless Upper Deck was defaming Topps in some way, you have to think that these companies have better things to spend their money on than going to court over “design infringement”.
