In an update to the Card Wars post, Upper Deck has gained the Upper Hand (pun intended), in the battle. A temporary restraining order was sought by Topps to prevent Upper Deck from releasing 2009 O-Pee-Chee and 2009 Series 2, but was denied by a New York court. See the full story here.
Not that they would ever do this, but, it almost seems as if this is something that Topps and Upper Deck colluded on to drive up interest in the product. This of course would assume that Topps would fire back with some Upper Deck remake. I don’t think the courts would be too pleased, if this were the case however. If they really wanted to drive up interest, especially in these economic times, they would start collaborating on their products and projects, creating positive controversy and limited availability cards. Think of the Topps “misprints” with George Bush and Mickey Mantle in the backround of the Jeter card. So, if Topps would create a subset of their Series 2 that looked like, say the 1989 Upper Deck set, and if Upper Deck allowed this but feigned being upset at it. Topps would then pull the cards, creating a higher demand for that product. Upper Deck could then pull their remake fo the 1975 Topps cards in reciprocity, creating further demand for Upper Deck Series 2. Hmmmmmm.
